Police Officer Acted Unauthorized as Assistant Public Prosecutor

An inspector from the police unit East Brabant worked unauthorized as an assistant public prosecutor (hOvJ) for almost a year because his certificate had expired.

The officer discovered in December that his hOvJ certificate had expired when he applied for the exam. After reporting to his supervisor, the Department of Safety, Integrity, and Complaints ruled that there was no intent or misconduct, but rather a human error. He confused the expiration date. The Public Prosecution Service of East Brabant has been informed. In every criminal case where this is relevant, a report is added to indicate that the assistant public prosecutor was unauthorized.

Mandated Authority
Between January 18 and December 11, 2024, the officer used his hOvJ powers approximately 140 times without certification. An hOvJ checks the legality of arrests and can detain or release a suspect.

Competent
Despite the lack of certification, the inspector was competent and met the requirements of the Police Academy for a new certificate. Thus, issuing a new certificate was merely a formality. He has ceased his duties as an hOvJ and must repeat the training. He continues to work, as being an hOvJ is a role within his position but not a full position. The police have taken measures to prevent this from happening again.
