Special Unit for Admission of Temporary Employment Agencies

The Ministry of Social Affairs and Employment is establishing a new unit that will determine whether temporary employment agencies can enter the market. Minister Eddy van Hijum states in a letter to the House of Representatives that no personnel may be lent without admission. This system aims to help address abuses in the sector and the exploitation of migrant workers.

Minister Eddy van Hijum of Social Affairs and Employment: “I am pleased that we can now take this step forward. It is necessary to more effectively address abuses in the temporary employment sector. Many abuses stem from fraudulent agencies and their clients who have created a business model based on underpayment of workers and substandard housing. It is a race to the bottom that pushes companies complying with the law out of the market. With this law, we can finally better identify the rotten apples.”

Admission System

This legislative proposal introduces an admission system for temporary employment agencies and companies that provide labor. Agencies may only operate if they are admitted. To be admitted, they must submit a Certificate of Conduct (VOG) and pay a deposit of one hundred thousand euros. Clients may only do business with admitted agencies.
A new agency will decide on the admission of temporary employment agencies on behalf of the minister and can suspend or revoke admission in cases of serious abuses.

Recently, the possibilities for carrying out these tasks within the ministry have been explored. It appears that the ministry is capable of handling this task. The minister has decided to establish a unit, and preparations have begun. This spring, it will be clear when the law can come into effect, depending on approval by the House of Representatives and the Senate. The minister looks forward to debating the legislative proposal.
