A report published today shows ongoing discrimination against EU medical devices in Chinas procurement market. This will guide the Commission in deciding further steps to restore a level playing field between the EU and China.
The report provides clear evidence of China unfairly restricting access for EU medical device producers to government contracts. The EU remains committed to engaging China in a constructive dialogue to address these discriminatory measures. Without an acceptable solution, the Commission will consider adopting IPI measures, which may result in restrictions or exclusion of Chinese bidders from EU government contracts.
Background
The report concludes that China has implemented various forms of direct and indirect discrimination against EU medical devices, leading to serious market access barriers across China. This affects all categories of medical devices. The IPI, effective from 29 August 2022, aims to promote fair access to international procurement markets.
The first IPI investigation was launched on 24 April 2024 in response to discriminatory practices in the Chinese market for medical devices.
Any measures under the IPI must be specific and proportionate, considering possible supply issues.
