Fine for Recovery Company After Fatal Work Accident

The company Collewijn Berging B.V. pays a fine of 35,000 euros imposed by the Public Prosecution Service (OM). In 2023, a fatal work accident occurred during operations, resulting in the death of an employee.

Fatal Work Accident

On March 1, 2023, a 52-year-old employee of the recovery company lost his life. He was trapped between the loading platform and the frame of a recovery vehicle while working on a hydraulic system. The Dutch Labor Inspectorate (NLA) initiated a criminal investigation under the direction of the OM to determine the cause of this fatal workplace accident. According to the OM, the company violated the Working Conditions Act and its related regulations. The company failed to ensure a safe working environment. Therefore, the OM imposes a fine of 35,000 euros.

Measures

The recovery company expresses regret over the death of one of its employees due to the accident and acknowledges that the accident was partly due to shortcomings in its occupational health and safety policy. Had this policy been better managed, the accident might have been prevented. The company takes full responsibility for the loss of its valued colleague. In discussions with the OM, the company demonstrated that it recognized and is addressing the shortcomings in its health and safety policy. Repairs to hydraulics are no longer performed by the company itself but outsourced to specialized firms. Additionally, there will be more frequent and structured physical supervision in the workshop, extra safety personnel will be trained, and the companys Risk Inventory and Evaluation will be updated and reassessed. Due to the constructive attitude of the company, the OM considers a fine of 35,000 euros to be a suitable resolution.
