The Public Prosecution Service (OM) in Northern Netherlands has decided to conditionally dismiss a case against a 41-year-old man from Enschede due to exceptional circumstances related to personal matters. The suspect is accused of having harmed the health of the victim, which led to the latters death.
On January 28, 2025, a hearing took place with the public prosecutor. There, the prosecutor indicated that the criminal case would be conditionally dismissed given the exceptional circumstances.
Proportional
At this moment, imposing a penalty is not considered proportional. Consequently, the case that was scheduled for February 7, 2025, in Assen is off the table. If the man comes into contact with the police or judiciary again in the next two years, this case can still be brought before the court.
Misuse
The suspect is a general practitioner and had a large quantity of medicines – carelessly – in stock. These medicines can pose serious health risks if misused. In this case, the intake of medicines on the night of September 2 to 3, 2023, led to the death of a man from Musselkanaal. The suspect is accused of having harmed the health of the deceased, leading to the latters death.
Conditional Dismissal
At an earlier stage, the OM communicated that the case would be handled by the court in Assen. However, following this prosecution decision, new circumstances have emerged that prompted the OM to reconsider this decision.
