Public selection procedure for the sale of former school at Lageweg 13 in Sirjansland
The previous sale period for the public sale of the plot of land with a former school building has expired without any valid bids being received. After the sale period, interested parties have come forward. Therefore, we are offering this property again through a public sale procedure. The new sale period starts on 27 March 2026.
Location and area
The plot is located at Lageweg 13 in Sirjansland. The plot includes a former school building. The plot is registered in the land registry as belonging to the municipality of Duiveland, section C, number 305, partially, with an area of approximately 639 m². In addition, we are selling a portion of the plot registered in the land registry as belonging to the municipality of Duiveland, section C, number 306, partially, with an area of approximately 7 m². In total, approximately 646 m². Collectively referred to hereinafter as: the Sold Property.
Purpose
The purpose of the sale is for the buyer to develop a minimum of 1 and a maximum of 4 dwellings on the Sold Property.
Environmental plan and functions
The Sold Property is subject to the Environmental Plan of the municipality of Schouwen-Duiveland, which entered into force on 1 January 2024. This plan includes, among other things, the permitted functions and rules regarding activities. Currently, the zoning plan 'Zonnemaire, Ouwerkerk, Sirjansland', established by the municipal council of Schouwen-Duiveland on 28 June 2012, applies as a temporary part of the Environmental Plan. Under this zoning plan, the Sold Property has the function designations (single designation) 'Maatschappelijk' and (double designation) 'Waarde – Archeologie – 6'. To use the Sold Property for residential purposes, the current functions must be changed to the residential function.

Minimum sale price
The minimum purchase price for the Sold Property is €240,000 excluding any taxes payable and excluding any other costs for which the buyer is responsible.
Intended use
The municipality wishes to sell the Sold Property with the aim of it being used for residential purposes in the future.
Spatial procedure
The buyer must undergo a spatial procedure (preferably an Out-of-Plan Environmental Plan Activity: BOPA) for the intended use (residential function). The buyer must have the necessary irrevocable (environmental) permits, which still need to be applied for by the buyer. All costs of this procedure are for the buyer's account. The municipality cannot guarantee that the intended use will be permitted or that the required (environmental) permits will be granted and become irrevocable. The municipality has an obligation to make every effort to enable the intended residential function. The (re)construction plan submitted by the buyer must comply with the spatial and urban planning conditions that apply to the Sold Property.
Property rights
Upon transfer, a right of superficies will be established on the Sold Property in favour of Stedin Netbeheer B.V. for a gas pipeline. The right of superficies to be established is described in the standard purchase agreement and the associated superficies deed.
Account must be taken of the interests of various managers of cables and pipelines. This is described in the standard purchase agreement and associated appendices.

Unconditional bid
The bid made by the bidder on the plot is unconditional and irrevocable. The bid cannot be withdrawn or amended.
Selection procedure
We will select the buyer based on the highest bid price, provided that the bidder meets all conditions and sale criteria.
If there are interested parties who have submitted the same highest bid, these parties will be invited and given the opportunity to submit a new, written bid. These new bids will be communicated (again) by the notary in the manner described below.
Submitting bids
Bids must be submitted using a completed registration form in a sealed envelope to the notary's office: Klaassen Netwerk Notarissen, Havenpark 40, 4301 CE Zierikzee, stating 'Bid public sale procedure Lageweg 13 in Sirjansland'.
Bid deadline
Bids must be submitted no later than Monday, 4 May 2026, before 12:00 to the notary's office.
Opening bids
The notary will open the bids on Wednesday, 6 May 2026, at 14:00 at his office at Havenpark 40 in Zierikzee. Only the bidders may be present at this time.
Right of award
The municipality reserves the right of award until no later than Monday, 11 May 2026.
Legal protection
Rejected candidates may, within a period of 20 calendar days after the selection decision (the intended sale to the candidate with the highest bid) has been communicated, appeal against the selection decision by initiating an interlocutory injunction (fast-track procedure) against that decision with the competent court of the Zeeland-West-Brabant District Court, location Middelburg. This period is a forfeiture period. This means that if the candidate does not initiate an interlocutory injunction within this period after the selection decision has been communicated, the rights to appeal against that selection decision in legal proceedings will have lapsed. The municipality will then be free to enter into a purchase agreement with the selected candidate. If an interlocutory injunction procedure has been initiated within the aforementioned period, the ruling in the interlocutory injunction will be awaited and no purchase agreement will be entered into (yet).
Reservations
The municipality expressly reserves the right not to make a selection and not to proceed with the award, and may terminate this public sale procedure at any time and for any reason.
