The officer who shot a suspect in the leg in Uden in June 2024 will not be prosecuted. Based on the investigation by the National Police Internal Investigations Department, the Public Prosecution Service (OM) concludes that the officer acted in accordance with the applicable guidelines.
In the early morning of June 12, 2024, the police received a report that a break-in was possibly occurring in cars on Oranjestraat in Uden. When the police attempted to apprehend the suspect in his car, the man ran over one of the officers. The officer fell to the ground and saw that his service dog was being dragged by the car. After a few moments, when the officer was confronted again with the unpredictable driving behavior of the suspect, he fired two shots. One of the shots hit the 31-year-old man from Zeeland in the leg.
Investigation
The National Police Internal Investigations Department conducted an investigation into the shooting incident. The OM looks at the entire incident for assessment. Very shortly before the moment of shooting, the suspect attempted to inflict serious bodily harm on the officer. The suspect was also convicted for this in January 2025 by the court.
No Prosecution
Police officers are permitted under the Official Instructions to use a firearm to avert immediate danger to the lives of individuals or to prevent serious bodily harm. In this case, that situation occurred, according to the OM. The officer in question acted in accordance with the Police Act and the Official Instructions, in the opinion of the OM. Therefore, there will be no criminal investigation, and the officer will not be prosecuted.
