Since January 1, 2024, every municipality has one environmental plan. An environmental plan is a plan containing all rules about the physical living environment. For example, rules about where you may build, but also about sewer connections or tree felling.
In Deventer, this plan currently mainly consists of old zoning plans and rules transferred from the national government to the municipality. We call this the temporary environmental plan. Municipalities have until the end of 2032 to convert this into a definitive environmental plan that fits the Environmental Act.
We do this step by step, per area. Bathmen is the first area where the rules from the old zoning plans are converted to the new environmental plan. The amendment applies to the built-up area of the village.
What changes?
The rules are almost transferred one-to-one. That means little changes. The adjustment is mainly needed to comply with the requirements of the Environmental Act. This means, among other things, that the rules are written differently.
There are a few differences with the old zoning plans:
- some rules for permit-free building are simplified. For example, when building a shed. Previously, a shed could be built in the achtererfgebied (backyard area). The complicated description of the backyard area is removed. Instead, the backyard area is shown as an area on the map.
- the broad social destination is split. This makes it clearer per location which types of social facilities can be established. For some social facilities, a permit is required to assess whether the location is suitable for that facility.
- the possibility to allow care homes with a permit in all houses is not carried over from the zoning plan. This does not mean that care homes are no longer allowed anywhere, but that they can be assessed differently. This does not apply to informal care homes, which are (and remain) allowed at almost all houses.
These changes initially apply only to the village of Bathmen. Later, these rules will also be adjusted for other parts of the municipality.
New housing locations are also being prepared in and around Bathmen. These are not part of this amendment. A separate process with its own moments for public participation will follow later. The environmental plan will then only be adjusted on these parts after this process has been completed.
Relation to environmental vision
The municipality is also working on an environmental vision. It contains ambitions for the living environment in 2040. The amendment of the environmental plan for Bathmen is separate from this. The policy from the environmental vision will be gradually incorporated into the environmental plan later. An environmental vision is more general than an environmental plan.
When can you respond?
This message is intended to inform you that the municipality is preparing an amendment. There are currently no documents for inspection. You cannot submit views at this time. That can only be done later. We announce this, among other things, via our website and via www.officielebekendmakingen.nl(Refers to an external website).
Walk-in session
When the college of mayor and aldermen has released the draft environmental plan for views, we organize a walk-in session in Bathmen. You can get information and ask questions there. Then the draft will be available for inspection for six weeks and you can submit views. The date, time, and location of this walk-in session will be announced later. The municipal council ultimately decides on the amendments to the environmental plan for Bathmen.
