The mayor and aldermen of Overbetuwe made an intention decision on December 16 to take over the public space of Résidence Park Tergouw under certain conditions. Public space includes the sewer system, paving, greenery, street lighting, and street furniture, excluding utilities for residences.

The municipality has asked the parking owners if they agree with the intention and conditions. If the owners agree, an intention agreement will be drawn up. This intention decision is valid until December 2026. Before that time, Park Tergouw must submit a plan and budget for the measures needed to meet the design requirements. This is necessary so that the council can make a decision about a possible takeover in 2026.

Why this intention to take over now?

Park Tergouw is currently private property and has had a residential destination since 2015, due to permission for permanent residence. On July 10, 2025, parking owners and residents asked the college of mayor and aldermen to express the municipalitys willingness to take over the public space in the park. If the municipality takes over the public space of the park, it can manage a clean, safe, and future-proof living environment. The municipality will ensure that the public space has the same quality as the rest of Overbetuwe.

What preceded this?

When the exploitation agreement was signed in 2014, it was stated that the park would remain private property. Therefore, the municipality has no obligation for maintenance and management of the public space in the park. Several discussions have since been held with residents, parking owners, and the municipality about the parks maintenance condition.

What are the main conditions?

  • The council has set conditions in the intention decision. The main conditions are:
    Park Tergouw will conduct independent investigations to determine if the design complies with laws and standards.
  • The municipality will assess the results of the investigations and the advice of independent parties on the measures needed to meet the design requirements.
  • Park Tergouw and residents will pay the costs for the investigations and measures needed to comply with laws and standards. The municipality will provide personnel to assess the investigation results and measures and to consult with the parks representatives.
  • Park Tergouw must demonstrate that the appointed representatives have formal mandate and support from all representative parties.
  • The municipalitys intention declaration is valid until December 2026.

What happens next?

Once Park Tergouw confirms in January that it agrees with the intention and conditions, the municipality will make agreements on next steps and an intention agreement will follow. If Park Tergouw submits the requested plan before December 2026, the council will decide on a takeover. If positive, work can begin. Once completed, the parks public space will be transferred to the municipality. This is estimated to be earliest mid-2027.
