The executive board of the Municipality of Overbetuwe announces, in accordance with article 16.138 of the Environmental Act, that on October 16, 2025, they entered into a cost recovery agreement based on sections 13.6 and 13.7 of the Environmental Act.
Agreement Content
The agreement was made with the developing party and concerns residential construction. The agreement relates to the parcels of land located at Rijksweg-Noord 16-16a in Elst, cadastral known municipality Elst, section K, numbers 6981 and 6980. The building plan includes the development and realization of nine (9) apartments.
The agreement contains arrangements regarding the development of the plan, the deviation from the environmental plan, the reimbursement of costs incurred by the municipality (cost recovery), and the conditions the municipality sets for its cooperation. The costs of the procedure and realization are for the developing party, as well as the costs of any compensation for damages.
The municipality has declared its willingness to cooperate with this development. The development does not fit within the rules of the environmental plan of the Municipality of Overbetuwe. Therefore, the municipality will start a zoning procedure to amend the environmental plan. The developing party has submitted an application for an out-of-plan environmental plan activity.
Inspection
You can inspect the business description of the cost recovery agreement from October 29, 2025, for a period of six (6) weeks at the reception desk of the town hall, Dorpsstraat 67 in Elst. This is possible Monday through Thursday from 8:30 AM to 5:00 PM and on Friday from 8:30 AM to 3:00 PM. The business description outlines the main points of the agreement and the inspection is free of charge.
