Need for Modernization
Various municipal councils have previously called for the modernization of the replacement scheme for council members. In response, the Minister of Interior and Kingdom Relations sought advice from the Advisory Board on the Legal Position of Political Office Holders (ARPA). The cabinets response to this advice promised a bill to update and expand the regulations.
Main Elements of the Bill
The bill primarily addresses four points:
More Flexible Replacement Periods
The current replacement period of 16 weeks for representatives and executives (due to pregnancy, childbirth, or illness) can be extended in 4-week increments, up to a maximum of 32 weeks. The total replacement duration per term remains 48 weeks.
Replacement Possible at Start of Term
The legal restriction preventing replacement at the start of office due to pregnancy and childbirth is removed.
New Terminology in the Electoral Act
The term temporary dismissal is abolished. Instead, representatives can be temporarily relieved of their duties due to pregnancy, childbirth, or illness.
Expansion of Leave Types for Executives
Leave types for executives are expanded, largely in line with the Work and Care Act (Wazo). This includes parental and care leave.

The bill is open for online consultation until mid-February and can be found here. Professional associations, interest groups, and other stakeholders are invited to respond.
