The rules for product liability will now also apply to new digital technologies, such as artificial intelligence (AI), and to circular products. Additionally, more parties can be held liable for products from outside the EU. Authorized representatives, logistics providers, distributors, and online platforms established within the European Union can also be held accountable. It will also become easier to prove that a product was defective and to obtain compensation for damages, thereby strengthening the evidentiary position of affected persons.
The rules from the revised directive are adopted one-to-one into the Civil Code, aligning as much as possible with existing rules in the same code. The cabinet has submitted the bill to the House of Representatives for consideration. Afterwards, the Senate will also deliberate on the bill. The bill will come into effect once both chambers have approved the proposal.
