No Reduction in Allowances Due to WIA Compensation
People who receive compensation due to errors in their disability benefits retain their allowances and other income-dependent schemes. The Ministry of Social Affairs and Employment has established a scheme that allows a one-time financial compensation without negatively affecting income-dependent schemes such as healthcare or rent allowances. This scheme goes into public consultation today. People can give their opinion on this topic until January 16, 2026. The first compensations are expected to be paid out during 2026.
Solution for Allowances
The compensation people receive is not counted as taxable income. The UWV pays the wage tax directly to the Tax Authorities. This allows affected individuals to keep the full amount, and their income basis for calculating allowances does not increase. Their rent allowance, healthcare allowance, and other income-dependent allowances remain as high as usual.
Process
Once the public consultation is completed, the Ministry of Social Affairs and Employment will process the results into a new version of the scheme. When the new version is finalized, it will be signed by the Minister of Social Affairs and Employment. After that, the UWV can begin implementing the scheme.
You can find the public consultation here.
