The energy label is becoming increasingly important for the purchase price, rental, and delivery of homes and other buildings. Therefore, it is essential that tenants, buyers, homeowners, and others can trust the quality of the energy label. The public supervisor will be appointed to ensure the quality even better.
Tasks and Intended Supervisor
The Admission Organization Quality Assurance Construction (TloKB) is the intended supervisor. The supervisor checks whether the parties involved in the energy label comply with the regulations. The supervisor also enforces in cases of misconduct and fraud with energy labels.
The supervisor will have the following tasks on behalf of the Minister of Housing and Spatial Planning:
- Identifying certifying institutions. These provide certificates and check whether the quality system of certificate holders meets the requirements.
- Ensuring that certifying institutions operate according to the prescribed rules. If they do not comply with the rules, the supervisor can enforce through a public warning or a penalty order. The supervisor can also suspend or revoke the certification of the certifying institution.
- Ensuring that energy labels are only recorded under certificate holders and according to the rules by energy advisors. If this is not complied with, enforcement can take place through a penalty order or revocation of the energy label.
The supervisor will not take over tasks from the parties in the energy label system and will utilize the knowledge and expertise within the existing certification and accreditation system as much as possible. The supervisor will only carry out checks and enforce where the existing system has insufficient effect.
