The Province of North Brabant adjusts the existing subsidy scheme Area-Oriented Termination of Livestock Farming Locations (GBV) midterm. From now on, livestock farmers who completely stop their livestock farming location can continue to use up to 15% of their permitted nitrogen space for a new activity at the same location. This makes participation more attractive because nitrogen no longer needs to be a limiting factor when starting a new economic function.

Legal basis through joint guidance

When processing permit applications, the province applies an adjusted guidance from provinces, the national government, municipalities, and environmental services, which also applies to the Lbv and Lbv-plus schemes. This guidance provides the legal basis to use a limited remainder of the nitrogen space (maximum 15%) for new activities upon full termination, while the remaining part is fully used for nature restoration. With this approach, the province expects to offer a careful solution for participants in the GBV scheme, following the ruling of the Council of State on December 18, 2024, regarding internal offsetting (Using remaining nitrogen space within your permit for a new activity at the same location).

GBV scheme: focused on nature restoration

The GBV scheme is intended for livestock farmers who want to stop completely or partially and aligns with the national Area-Oriented Termination measure of the government. The scheme targets locations within 1,000 meters of nitrogen-sensitive and overloaded Natura 2000 areas, where termination of livestock activities contributes significantly to reducing nitrogen deposition.
