DCMR Environmental Service Rijnmond imposes various sanctions on Chemours on behalf of the provincial government of South Holland. DCMR observed 5 violations during inspections. These primarily related to improper storage or labeling of waste materials and the failure to timely submit reports on emergency power supplies.
The amount of the sanctions and how long Chemours has to rectify the violations varies by violation. If Chemours does not rectify the violation in time, they must pay the amount of the associated sanction.
No effects outside the company are expected from the observed violations. Most violations have now been resolved by Chemours. Nevertheless, we find it important that Chemours permanently rectifies the violations or takes organizational measures to prevent recurrence. The amount of the penalty varies from €10,000 to €15,000 per violation.
Penalties
A penalty order is intended to prevent or rectify a violation. This means that an offender must pay a monetary amount when they err again and fail to take measures to prevent this. This is the standard procedure in environmental law.
