Supervision is one of the three core tasks of the judiciary and thus holds an important position within our court, in the lives of those involved, and in society. For this reason, The Hague Court has established a new Supervision team, combining the Insolvency teams and the Guardianship, Administration and Mentorship section (CBM) of the Canton team (The Hague location). The new Supervision team started on 1-1-2026. 

Different Components

The Supervision team consists of different components. The work includes both handling requests for establishment or admission, as well as exercising supervision after assignment or judgment.

Guardianship, Administration and Mentorship (CBM)

CBM is intended to protect adults who can no longer properly manage their financial or personal affairs themselves, for example due to illness, disability, addiction or old age.

The administrator manages the money and goods of the person involved.

The mentor makes decisions about the personal care of someone who cannot do this well themselves, for example about treatment, nursing or guidance.

The curator arranges all personal and financial affairs of someone who cannot do this themselves.

The cantonal judge establishes one or more of these measures. The cantonal judge also supervises the work of the curator, administrator and mentor.

Management of Minors Assets

The Supervision team handles cases where a minor receives assets, for example through inheritance or compensation, and supervises the management thereof.

Insolvencies

Within the Bankruptcy Act, the Supervision team handles requests for bankruptcy declarations, suspensions of payment, requests for admission to the Debt Restructuring for Natural Persons Act (Wsnp), requests for imposition of a debt restructuring agreement, provisional measures and WHOA agreements.

After a bankruptcy or Wsnp ruling, the supervisory judge supervises the appointed curator or Wsnp administrator. The supervisory judge also assesses requests submitted during the bankruptcy/Wsnp procedure.

Debt Officers

Furthermore, the Supervision team offers help to people with debts in all legal areas of the court. The debt officers can refer litigants struggling with problematic debts to the municipality for assistance. Fraud Consultation Hour

Finally, there is close cooperation with the District Public Prosecutors Office in combating bankruptcy fraud. Three times a year, a fraud consultation hour is organized for curators and curators are encouraged to report suspicions of fraud to law enforcement agencies.
