A 28-year-old man was convicted of intentionally and premeditatedly stabbing a 23-year-old man to death at Hoofddorpplein in Amsterdam on the night of August 8 to 9, 2024. He was also guilty of possession of child pornography and having a gas-powered pistol. The court considers the man to have diminished responsibility and sentences him to 10 years imprisonment with TBS. 

The 23-year-old victim was unsuspectingly with his friends at Hoofddorpplein on the night of August 8 to 9, 2024, when the 28-year-old man ran at him wrapped in a tarpaulin and stabbed him in the chest with a meat knife. When the victim tried to escape, he fell forward to the ground and died a few minutes later from his injuries. At the scene, a folded tarpaulin containing a knife was found.

Camera footage and witness statements

There is no camera footage of the stabbing incident itself, but there is footage of the immediate surroundings in the hours before and after the stabbing. In the footage before the stabbing, a person wrapped in a car cover is seen moving towards Hoofddorpplein. Also, a man is seen running away over the Aalsmeerweg immediately after the stabbing, without a tarpaulin. This fits perfectly with witness statements that speak of a man under a tarpaulin stabbing the victim, then dropping the tarpaulin and running away over the Aalsmeerweg. The footage also clearly shows a tarpaulin lying on the street immediately after the stabbing, while there was no tarpaulin visible at that spot just before. The court therefore assumes that the man seen running away over the Aalsmeerweg in the footage is the perpetrator. 

The 28-year-old man denies being the perpetrator. But according to the court, there is sufficient evidence that he is the perpetrator. DNA traces of him and the victim were found around the stab wounds on the inside and outside of the tarpaulin. The man also has no alibi and matches the description of the perpetrator on the camera footage. He had long had an excessive interest in Hoofddorpplein and a group of youths who regularly stayed there.

Premeditated plan

The court rules that the man had a premeditated plan. The determination and decisiveness with which he stabbed the victim is extremely shocking. From the file, the court strongly suspects that the man targeted the victim because he was part of a group of boys who, according to his own account and perception, harassed and threatened him. 

The man is also convicted for possession of child pornography from September 24, 2014 to September 8, 2024, and possession of a gas-powered pistol from June 21, 2023 to September 8, 2024. 

Diminished responsibility

Although he refused to cooperate with psychiatric examination, experts established that he has complex psychological problems. The court finds, based on all reports, that at the time of the offenses there was a defective development or pathological disorder of mental faculties, resulting in diminished responsibility. The court imposes a TBS measure and a prison sentence of 10 years. Because a TBS measure is imposed, the court sees reason to impose a lower prison sentence than the 16 years demanded by the public prosecutor. The man must pay nearly 80,000 euros in damages to the parents, brother, and sister of the victim.
