Camera footage and witness statements
There is no camera footage of the stabbing incident itself, but there is footage of the immediate surroundings in the hours before and after the stabbing. In the footage before the stabbing, a person wrapped in a car cover is seen moving towards Hoofddorpplein. Also, a man is seen running away over the Aalsmeerweg immediately after the stabbing, without a tarpaulin. This fits perfectly with witness statements that speak of a man under a tarpaulin stabbing the victim, then dropping the tarpaulin and running away over the Aalsmeerweg. The footage also clearly shows a tarpaulin lying on the street immediately after the stabbing, while there was no tarpaulin visible at that spot just before. The court therefore assumes that the man seen running away over the Aalsmeerweg in the footage is the perpetrator.
Premeditated plan
The court rules that the man had a premeditated plan. The determination and decisiveness with which he stabbed the victim is extremely shocking. From the file, the court strongly suspects that the man targeted the victim because he was part of a group of boys who, according to his own account and perception, harassed and threatened him.
Diminished responsibility
Although he refused to cooperate with psychiatric examination, experts established that he has complex psychological problems. The court finds, based on all reports, that at the time of the offenses there was a defective development or pathological disorder of mental faculties, resulting in diminished responsibility. The court imposes a TBS measure and a prison sentence of 10 years. Because a TBS measure is imposed, the court sees reason to impose a lower prison sentence than the 16 years demanded by the public prosecutor. The man must pay nearly 80,000 euros in damages to the parents, brother, and sister of the victim.
