The Public Prosecution Service (OM) demands 10 years imprisonment for the manslaughter of a Polish man in the summer of 2024. According to the public prosecutor, the suspect is guilty of the mans death because he, together with someone else, punched and kicked him.

The victim was found unconscious on June 24, 2024, on a garden chair in a garden in Bunschoten-Spakenburg. He was in poor condition and bystanders called emergency services. The man died four days later in the hospital.

After police investigation, camera footage from a few days earlier was found. It shows the man being assaulted by two other men. The men punched and kicked the victims head multiple times. One of them later reported to the police station. The other suspect is still unknown.

Pointless violence

According to the OM, the suspect is guilty of the death of the Polish victim. This is evident from the camera footage, but also from various forensic reports. The medical examiner concludes that the victim died of brain injury. The pathologist states that this injury was caused by powerful punches to the head. That the injury only became apparent a few days after the assault is not unusual. Due to the slow growth of bleeding in the head, it can take several days before symptoms are noticed.

According to the public prosecutor, this is a clear case of pointless violence. The victim showed no sign of aggression. Yet the two suspects approached the victim and started hitting and kicking him. The suspects explanation – that he was very drunk and remembers nothing – does not change this, according to the public prosecutor.  

Extreme outburst of violence

This is a very serious case, says the public prosecutor. “The victim still had many years ahead of him, but was taken from life without any reason. His parents, sister, partner, and children will have to go on without him.”

When determining the sentence demand, the OM looks at the personal circumstances of the suspect and the nature and facts of the case. The public prosecutor finds it very worrying and reprehensible that the suspect came to such an extreme outburst of violence under the influence of alcohol. There was no reason to attack the victim. All things considered, the public prosecutor finds a prison sentence of 10 years appropriate.
