Two members of the arrest team will not be prosecuted for their involvement in a shooting incident on Speelmanstraat in Rotterdam. This decision was made by the Public Prosecution Service based on the investigation by the National Criminal Investigation Department.
During a raid by the arrest team on Speelmanstraat on January 4, a 30-year-old man was killed. A 29-year-old man and a 27-year-old woman were injured. Following the incident, the National Criminal Investigation Department conducted an investigation.
During a reconnaissance, just before the raid, the front door of the house on Speelmanstraat was suddenly opened. After a brief exchange of words in the hallway, a shootout occurred between a suspect and two members of the arrest team. The suspect was killed by a police shot. It has been established that the other man and the woman were not injured as a result of police actions.
Official Instruction
Police officers may use a firearm under the Official Instruction to avert immediate danger to life or to prevent serious bodily injury. The Public Prosecution Service concludes that this situation indeed occurred. There was a lawful use of force by both police officers. They acted in accordance with the Police Act and the Official Instruction and will therefore not be prosecuted.
