On Thursday, November 6, a thematic session on bankruptcy fraud will take place before the summary court in Haarlem. Five criminal cases will be heard in which the Public Prosecution Service North Holland suspects bankruptcy fraud.

When a (legal) person is declared bankrupt by the court, a trustee is appointed to handle the bankruptcy. The trustees task is to map out the rights and obligations of the bankrupt person or company. Among other things, he will inventory assets and debts and try to pay the remaining creditors.
To properly perform this task, the trustee needs the administration of the bankrupt (legal) person.

The trustee must also be properly and fully informed, for example about outstanding debts, business inventory, ongoing work, and orders. If the trustee does not receive administration and information, this is a criminal offense.

The five criminal cases scheduled for hearing this Thursday concern directors of various bankrupt legal entities who have violated their duty to provide and maintain administration and/or their duty to provide information. In these cases, the trustee has filed a report of bankruptcy fraud. In one case, a suspect also removed a car from the estate of the bankrupt legal entity by registering it in his own name.

The criminal cases will be heard from 9:00 AM. The last case is scheduled for 11:40 AM.
