The Public Prosecution Service is summoning a foreign pension fund on the suspicion of evasion of dividend withholding tax. Investigation into a former employee is still ongoing.

The pension fund in question reclaimed and received dividend withholding tax from the Netherlands tax authorities for the years 2013 up to and including 2018. In September 2019, the tax authorities launched an audit into the pension fund once the suspicion had arisen that it had wrongly reclaimed withheld dividend tax. The total amount of dividend tax wrongly reclaimed and received by the pension fund exceeds over 200 million euros.

The Netherlands Fiscal Intelligence and Investigation Service (FIOD), under the direction of the Public Prosecution Service, has investigated the case. The outcome of the investigation is that the pension fund is suspected of having reclaimed dividend tax in violation of the Netherlands Dividend Withholding Tax Act, even though it had no right to it. The fund is therefore suspected of tax evasion. Investigation into a former employee is still ongoing.
