The Public Prosecution Service (OM) has demanded a 3-year prison sentence against a 47-year-old Polish man without a fixed residence or abode before the court in Rotterdam in Dordrecht. The public prosecutor of the National Office suspects him of possession, distribution, and production of child pornography. The suspect has previously been convicted of similar offenses in both Poland and the Netherlands.
The 47-year-old Pole was definitively sentenced in April 2024 by the Court in The Hague to a prison sentence of two years, of which eight months were conditional, for possession of child pornography. Shortly after that conviction, still during his probation period, he reoffends. From July 2024, the Team Combating Child Pornography and Child Sex Tourism (TBKK) of the Unit for Investigation and Interventions receives new foreign reports about the suspect. It appears that he again possesses and has distributed images of child sexual abuse on platforms including Google Photos and Facebook.
Minor niece
The police managed to locate the man and arrested him on December 3, 2024, in Almelo. He had his phone with him. There were indeed images of child sexual abuse that he had shared. In addition, he had edited 183 photos. These were photos of his minor niece, to which the suspect had pasted a photo of his exposed genitals next to her face and body. He is therefore also on trial for producing child pornography.
Addiction
The suspect struggles with an alcohol and hard drug addiction, and a pedophilic disorder has been diagnosed in him. He admits that he watches child pornography when under the influence. He claims not to remember that he pasted a photo of his genitals onto the photo of his niece. The public prosecutor sees the suspect as a repeat offender who does not take responsibility for his actions.
Two years ago, the suspect still claimed to realize that by watching child pornography, he sustains the market and that it involves children who are severely sexually abused. The reality is that he immediately continued with it after his release.
The Public Prosecution Service considers the risk of reoffending to be high. Besides the Netherlands, he was also convicted in Poland in 2022 for sharing child pornography and animal pornography. For this case, he received a 4.5-year prison sentence, of which he still has over four years to serve. Furthermore, he is a suspect in two other open Polish cases. He has sent child pornography to a girl under the age of 15. He has not yet been convicted for this because he fled.
Measure
In addition to the demanded prison sentence in this case, the Public Prosecution Service is seeking the conditional prison sentence of eight months from his previous conviction. The prosecutor also demanded a behavioral and freedom-restricting measure. The expectation is that if he returns to Poland, he will still serve a number of years in prison there and will be treated.
