On the night of the parade, CV De Centrumknollens float was on its way to their storage after the event. Several people were pushing the float with a pole, supported by an electric motor. While crossing the railway, the barriers came down due to an approaching train. Despite their efforts, they could not clear the crossing in time.
The train collided with the back of the float, causing severe damage to both the float and the train. The driver sustained injuries and required hospital treatment. Shortly after the accident, another train passed by from the opposite direction, sustaining minor damage from the debris.
Liability for the accident
Following the incident, numerous witnesses were interviewed and a thorough technical investigation was conducted. The Public Prosecution Service concluded that the association caused danger to railway traffic and holds responsibility for the accident. They also considered a report from ProRail, which stated that the special crossing procedure should have been followed.
Conditionally dismissed
The Public Prosecution Service found that the association did not act according to the special crossing procedure and should not have endangered railway traffic. However, they believe that criminal prosecution is not appropriate in this case. They do not see added value in going to court. The focus is on prevention by raising awareness of the special crossing procedure.
Overall, the Public Prosecution Service decided to dismiss the case against the carnival association under conditions. The association will not be prosecuted, provided they actively promote the special crossing procedure among members and other carnival associations.
