This amount is called the court fee. Different rates apply depending on the type of procedure and the status of the person submitting the (higher) appeal.

The type of procedure can be an appeal or a higher appeal. In an appeal procedure, you appeal directly to the Administrative Jurisdiction Division of the Council of State against a decision of a government body. In a higher appeal procedure, you appeal to the Administrative Jurisdiction Division of the Council of State after a court ruling.

The State Secretary for Justice and Security has increased the court fee amounts effective January 1, 2026.

Transitional law

For (higher) appeals received on or after January 1, 2026, and directed against the same decision or ruling as another (higher) appeal received in 2025, the ‘old’ amounts still apply.
