In 2026-2027 we will also take additional steps in permitting, supervision, and enforcement to strengthen our permits. This is necessary to overcome the so-called nitrogen lock and enable developments in business expansion, housing construction, and safe roads. It is also important to protect nature.

New Policy

Policy will be introduced to revoke permits from companies that have ceased operations. This prevents old permits from being reused, which could increase nitrogen emissions. We will also work with municipalities to explore smarter ways to grant nature permits for housing construction. Additionally, we will further develop the policy for PAS reporters.

Amending Environmental Permits? Then Also Amend Nature Permits

We want companies renewing their environmental permits to immediately adjust their nature permits as well. It is the responsibility of municipalities and environmental agencies to adjust environmental permits. We aim to make agreements with them on this. Companies near Natura 2000 areas that change their activities will receive extra attention in supervision and enforcement.

Targeted Permits

We were the first province to grant targeted permits. From 2027, we will develop an approach to implement this on a larger scale. This means clearer guidelines on applying innovative measures to reduce emissions. Entrepreneurs can better choose techniques that suit their businesses.

Priority Handling of Permits

Permits will no longer be processed in order of receipt. Priority will be given to:

  • Applications that achieve the greatest nitrogen reduction for Natura 2000 areas
  • Permits for projects that help solve grid congestion
  • Permits that cannot wait

Prepared for New Rules and Rulings

New developments or court rulings may affect permits. Therefore, the province is creating a playbook so experts can act immediately if needed. This allows faster preparation of guidelines, advice, or adjustments. It helps reopen the permit application desk more quickly.

Overcoming the Nitrogen Lock

In addition to reducing nitrogen emissions and restoring nature, we are now also taking steps in permitting, supervision, and enforcement. This allows us to better substantiate our permits so they remain legally sound in case of objections. Overcoming the nitrogen lock is important to provide clarity and perspective to residents and businesses in Gelderland.
